These conditions of sale (hereinafter only "General Conditions") govern the sale of products marketed by Ruocco Home.
All product purchase contracts concluded, through the site and according to the procedures indicated therein, between the Seller and the Customer, will be governed by these General Conditions.
Purchase methods
1. The Customer can only purchase the products present in the Ruocco Home electronic catalog at the time the order is placed, as described in the relevant information sheets. The technical information included on the site faithfully reproduces that of the manufacturers of the goods included in the catalogue. Ruocco Home, therefore, reserves the right to modify the technical information of the products to adapt them to that provided by the manufacturers, without the need for any prior notice. It is understood that the image accompanying the descriptive sheet of a product may not be perfectly representative of its characteristics, and may differ in colour, size, accessory products present in the figure.
2. The correct receipt of the order is confirmed by Ruocco Home via an email, sent to the email address reported by the Customer during the purchase phase. This confirmation email will contain the date and time of receipt of the order, the order number, the details of the products purchased, the shipping address and the chosen payment method. The Customer undertakes to verify its correctness and to promptly communicate any corrections, by email or by telephone by contacting Customer Service.
3. All prices on the site are intended as public prices and, therefore, include VAT. Ruocco Home reserves the right to change prices at any time, without notice.
4. Any right of the Customer to compensation for damages or compensation is excluded, as well as any contractual or non-contractual liability for direct or indirect damage to people and/or things, caused by the non-acceptance, even partial, of an order by Ruocco Home .
Buyer's obligations
The buyer is prohibited from entering false and/or imaginary data in the registration procedure necessary to activate the process for the execution of this contract and the further related communications; the personal data and e-mails must be exclusively your real personal data and not those of third parties or fictitious ones.
The Customer indemnifies Ruocco Home from any liability deriving from the issuing of incorrect tax documents due to errors relating to the data provided by the Customer, the Customer himself being solely responsible for the correct insertion.
The Customer undertakes, once the online purchase procedure has been completed, to print and keep these general conditions, which they will have already viewed and accepted as an obligatory step in the purchase, and to print the specifications of the product being purchased.
The guarantee of the successful completion of the payment that the Customer makes with the means indicated above is of an essential nature, so that by express agreement the Customer's failure to comply with said obligation will determine the legal termination of the contract without the need for a judicial ruling, without prejudice to Ruocco Home's right to take legal action for compensation for further damage.
Contractual termination and express termination clause
Ruocco Home has the right to terminate the stipulated contract by simply communicating this to the Customer; in this case the customer will only have the right to a refund of any sum already paid.
Right of withdrawal
1. Pursuant to art. 64 et seq. of Legislative Decree no. 206/2005, if the Customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his professional activity, or does not make the purchase by indicating a VAT number in the order form to Ruocco Home), has the right to withdraw from the purchase contract for any reason, without any penalty. The right of withdrawal cannot be granted to companies (purchase with VAT number).
2. To exercise this right, the Customer must send Ruocco Home a communication to this effect, within 14 days from the date of receipt of the goods. This communication may take place by sending an email to info@ruoccohome.com or by sending a registered letter addressed to:

3. Within the same period, the Customer must return the goods.
The right of withdrawal is subject to the following mandatory conditions:
The right applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the purchased product (e.g.: sheet, pillowcases, etc.);
The right of withdrawal is completely lost if the goods are not returned intact, complete in all their parts or have not been used. In the event of forfeiture of the right of withdrawal, Ruocco Home will return the purchased good to the sender, charging the shipping costs to the sender.
Shipping costs relating to the return of the goods are borne by the Customer;
The shipment, until receipt is certified in our warehouse, is under the complete responsibility of the Customer.
In the event of damage to the goods during transport, Ruocco Home will notify the Customer of the incident (within 5 working days of receiving the goods in its warehouses), to allow him to promptly file a complaint against the courier he has chosen. Ruocco Home reserves the right to charge the Customer for any damage suffered by the goods during the return shipment, withholding the amount of damage suffered from the amount to be refunded to the Customer.
Ruocco Home will reimburse the Customer the amount already paid for the purchase of the goods, within 10 days of his return, through a procedure for reversing the amount charged to the credit card or by bank transfer. In the latter case, it will be the Customer's responsibility to promptly provide the bank details on which to obtain the refund (IBAN code of the order holder).
4. No returns are made for products made to measure or personalized by the Customer.
Promotions
Promotions cannot be used on already discounted items or on other active promotions, unless otherwise indicated by Ruocco Home.
Applicable law
1. The sales contract between the Customer and Ruocco Home is intended to be concluded in Italy and regulated by Italian law. For the resolution of civil and criminal disputes arising from the conclusion of this distance selling contract, if the Customer is a consumer, the territorial jurisdiction is that of the relevant court of his municipality of residence; in all other cases, the territorial jurisdiction is exclusively that of the Court of Naples.
